TMZ is reporting that the Los Angeles County Department ofChildren and Family Services is conducting an active investigation of Britney Spears.  An unscheduled hearing was held today at Superior Court attended by lawyers for Britney, Kevin Federline, and the dependent minor children (aka Jayden James and Sean Preston Federline).

The complaints do not involve physical mistreatment. Rather, the allegations include poor dental hygiene and inappropriate eating and sleeping habits for the boys.

TMZ is assuming that Britney is being investigated for possible child abuse but I wonder if it’s possible that Children and Family Services is involved because of the custody battle. 

Speaking of which, People reports that Britney’s ex-manager, Larry Rudolph, is avoiding attempts by Kevin’s lawyers to subpoena him. Ryan Seacrest remarked on his KIIS radio show earlier this morning that Larry ‘wants it publicly known‘ that he is avoiding being served.

Here is a guy who was with her from the beginning, watched her rise tomassive success, was her dear friend and confidante, then was fired andnow doesn’t want to have to speak in court, because he wants to beloyal to her. There’s another chapter to this.

He said he’s doing his best to hide from Kevin’s process server. He’s actually on the run. They are trying to track himdown and serve him with a subpoena and they want him to appear andtestify in the custody battle. [He] doesn’t want to be served because he said it won’t be good forBritney.

After all they have been through he is stillloyal to her, and he doesn’t want to have to go under oath and talkabout certain things that might hurt her.

Additionally, on Friday the SPCA attempted to make contact with Britney after receiving reports that her Yorkie puppy, London, was spotted in a cast or had a broken leg that was otherwise left untreated, but Britney was out of town. However, Britney was cleared earlier today after the SPCA received written confirmation from a vet that the dog was treated.

According to X17online.com, SP and JJ were brought to Promises by a bodyguard and met by Britney’s mom, Lynne Spears, but People magazine‘s sources are saying that it was their dad Kevin Federline who brought them.  After a two hour visit, the boys went back to Kevin’s house where they have been staying.

Kevin had also visited Britney on Friday. People’s source told them,

The kids are his No. 1 priority and they always have been. He’s so stressed out right now. He only wants the best for Britney and the kids.

According to X17online, last evening she went to Kevin’s house and rang the bell, but he didn’t answer.  Her assistant begged photographers to stop taking photos, but of course they didn’t.  Britney got mad and started attacking a car and a photographer with an umbrella, and cursing at them before running back to the car and driving away. We don’t condone any kind of violence (even against cars) but who can blame her for being so pissed?  The paparazzi is part of the problem and they are only making it worse by following her. On the video, you can hear a photographer saying, "We’re worried about you."  If they’re so worried, why don’t they leave her alone?

Anyway, turns out Kevin was home with JJ and SP.  Half an hour later, he drove to Britney’s Malibu home where the couple talked.  One can surmise that they came to an agreement about her going back to rehab because she checked herself in late last night.

We REALLY hope the third time’s a charm.

Kevin Federline, Britney’s ex-husband, is said to not be using the situation against Britney, but rather wants to ensure that he is there for them and that Britney is okay;

It’s not about getting the kids away from Britney. He’s just worried about making sure he can see them. He [even] canceled plans to go to Las Vegas last weekend to physically be in L.A. if Britney or the kids needed him. Kevin wanted her to get help so she could be a good mother for their kids and not end up dead. He just couldn’t take it anymore. He was desperate for her to get help.

Britney and Kevin’s previous custody agreement ends this month and he has filed for an emergency court hearing to review the situation with their sons, and who will care for them.

Britney has an array of people supporting her at this hard time including, her mom, Lynne, dad, Jamie, sister, Jamie Lynn, Kevin and Larry.

The American Academy of Pediatrics recommends that:

Children should face the rear of the vehicle until they are at least 1 year of age and weigh at least 20 lb to decrease the risk of cervical spine injury in the event of a crash. Infants who weigh 20 lb before 1 year of age should ride rear facing in a convertible seat or infant seat approved for higher weights until at least 1 year of age.

Oh No They Didn’t has more photos that show that Jayden’s car seat IS strapped in so it’s not like she just placed it on the seat temporarily. Sean Preston’s straps are loose too, which is not safe. The straps should fit snugly around the shoulders and clasp in the middle of the chest.

This is the third time Britney has made a serious error in judgement when it comes to car safety for her children.  The first time was when she drove with Sean Preston on her lap, and the second time was when she drove with him forward facing before he was a year old with shoulder straps so loose that he flopped over.

Note: We normally refrain from linking or publishing photos of children inside of cars as it is invasive, but this is a special case.  And to those who say we should "just leave Britney alone," we feel that this is an important enough issue to raise awareness of.  We couldn’t care less if Britney wears underpants, who she dates, which celebutante she hangs out with, but proper installation and restraint of infants and children in cars can save lives.  A reader just emailed that she lost her nephew in a car accident because he was not strapped into his car seat properly. My mother’s friend lost her granddaughter in a car accident. The four other people in the car suffered injuries but their daughter went through the windshield because she was not wearing a seat belt. Please learn from their serious mistakes.

"He wants to be with them," a friend told In Touch.  "He doesn’t think she’s a good mom."

Kevin is planning to prove that Britney is a bad mother, including using her recent partying behavior and bad habits, like smoking and drinking, against her. A friend of the rapper reportedly told OK that on Nov. 28 Kevin requested that courts to test Jayden to see if alcohol was present in his system. "He claims Britney breastfed for the first weeks after his birth and was drinking during that time."

Kevin is also supposedly bringing his parents into the equation for help getting custody. Kevin’s mom Julie "plans to consult her attorney regarding grandparent rights and possible custody of the kids." an insider says.

The 28-year-old rapper/backup dancer has had plenty of chances to experience "daddy fat." He has four children, including Kori and Kaleb with ex-girlfriend Shar Jackson, and Sean Preston and Jayden with Britney.
