Larry Birkhead's first Father's Day

In anexclusive interview with OK! Magazine, Larry gave all the details onthe big day, Dannielynn’s new milestones and how they remember Anna Nicole.

Florida judge says Larry Birkhead has to wait for California ruling

Dnatestkit_1 Florida family court Judge Lawrence Korda said that he can’t decide whether a DNA sample may be taken from Anna Nicole Smith‘s daughter Dannielynn to see if Larry Birkhead is her biological father because he doesn’t have jurisdiction.  Los Angeles County Superior Court Judge Robert Schneider will be making the decision on whether a DNA test may be performed.

The Florida judge ordered a DNA sample to be taken from Anna’s body prior to burial for future potential testing.  He also said, somewhat confusingly, that is it "conceivable" by Florida law for Dannielynn to have two fathers.  Huh?

Many people are asking what’s so difficult about performing this test that they won’t allow it to be take place.  It has nothing to do with actually performing the test.  It’s a fairly routine procedure- after all, they’re doing it on CSI all the time, right?  It’s also physically non-invasive- just swab the inside of the cheek (test kit pictured above). The overriding issue is Dannielynn’s current guardian’s desire to have the test performed. So the question is – why does Howard not want to have the test performed?  The most obvious answer is that Howard knows he isn’t Dannielynn’s biological father and in refusing to consent to the test, he secures his position as her guardian. 

TMZ’s sources tell them that Howard will cooperate if the price is right.  He wants the boat and house that Anna bought before her death (not where he is staying now). He would also get control of Dannielynn’s inheritance (which includes all of Anna’s assets).

In respect to the disposition of her mother’s body, Richard Milstein was a guardian ad litem, appointed to represent the interests of Dannielynn with respect to a single action.  He can’t make the decision in other actions. She will likely be assigned another in California, but it doesn’t appear that the person will be able to make the decision outside of a court.

Rumor: Larry Birkhead in The Bahamas for DNA test

Anna Nicole Smith’s possible baby’s daddy, Larry Birkhead, is reportedly in the Bahamas to ensure that he and Anna’s daughter, Dannielynn Hope , are DNA tested for paternity. Perez Hilton is reporting that a source told him that the photographer flew down to the island where Anna lives with the baby and her “husband” Howard K. Stern. Larry is said to have reported to the local police, giving a deposition, before going to visit the grave of Anna’s son, Daniel.Anna was given a deadline, by a California judge, to submit Dannielynn to a DNA test. Anna says that her life partner Howard is Dannielynn’s father, not her ex, Larry.Source: Perez Hilton

Anna Nicole has until Jan. 23 to have daughter DNA tested

The clock has started ticking for Anna Nicole Smith. The former stripper/pinup/Trimspa rep/ reality TV star has until January 23 to have her nearly 4-month-old daughter Dannielynn Hope’s DNA tested, as ordered by Superior Court Judge Robert Schnider.

Anna’s former boyfriend, Larry Birkhead, began legal proceedings in October for paternal rights to Dannielynn after Anna declared her long-time lawyer and new "husband" Howard K. Stern was actually the infant’s father.

"We can’t make it any easier for her – all she has to do is get out of bed, put on a robe, and answer the door," Larry’s attorney, Debra Opri, said Tuesday, explaining that her lab would even send reps down to the Bahamas, where Anna resides, to get a DNA swab.

Dannielynn Stern must be DNA tested

Annanicole_smith180The first step in photographer Larry Birkhead‘s fight to prove the paternity of Anna Nicole Smith‘s daughter Dannielynn, 3 1/2 months, has been a success. In a ruling released Thursday, a judge ordered a paternity test to reveal whether the biological father is Larry, 33, or Howard K. Stern, 38.

Of the ruling, Larry said, "If I was on anybody’s Christmas list, they can scratch me off because this is the best Christmas present I could have ever received…I’m one step closer to beginning a relationship with my daughter."

However, Anna’s lawyer countered by claiming that the judge threw out 80% of their case. No word on when the paternity test will take place, or if the results will be revealed to the public.

Anna Nicole Smith's ex Larry Birkhead accuses her of dyeing baby's hair

Annaetfamilie In what must be the most headscratching legal story of the year (or at least the month), Anna Nicole Smith‘s ex-boyfriend Larry Birkhead is accusing Anna of coloring the hair of her 2 month old daughter Dannielynn Hope Marshall Stern black to make it look like she is her "husband" Howard K. Stern‘s child instead of his.  Howard has dark brown hair. 

Larry’s attorney Debra Opri said on Monday that Larry saw images of Dannielynn with dark hair in snippets of Anna’s Entertainment Tonight‘s exclusive interview, airing tonight on CBS.  She said, "It’s horrendous.  We are calling our experts right now to see if dyeing an infant’s hair is any way toxic or harmful to a child."

ClairolhydrienceWe think this story is ridiculous.  How can Larry and his lawyer forget that Anna is no stranger to a bottle of hair dye herself?  Her hair is not naturally platinum blonde so it’s altogether possible that Dannielynn has naturally dark hair.  Besides, wouldn’t it have been easier to slap a Baby Toupee on her?  Besides, maybe it’s just semi-permanent!

Larry has filed two lawsuits.  The first demanded that Anna return to California with Dannielynn to submit to DNA tests.  The second lawsuit filed in the Bahamas alleges that Anna and Howard have committed fraud and conspiracy.

Meanwhile, Anna was hospitalized for "a slight case of pneumonia" at Doctor’s Hospital, the same hospital where she gave birth to Dannielynn and where her son Daniel died.

On the birth:  “They thought the baby was going to be too big, and it was going to bust my womb…. So they had to do a caesarean. I had an epidural, but it did not kick in. I felt everything.” Dannielynn ended up only being 6 lbs, 9 oz!

Our correspondent Robin Elise Weiss, LCCE, of About.com’s Pregnancy/Birth section, tells us, "Ultrasound is not an accurate predictor of fetal weight.  And yet many women experience births like Anna Nicole’s, being told the baby is "too big" only to give birth to a baby much smaller than predicted.  Some new studies indicate that using estimated fetal weight solely to make decisions about mode of birth like induction and scheduled cesarean are not appropriate for most women."

On having more children: “Howard definitely wants more children…Dannielynn’s so beautiful. When…I saw her [for the first time], I saw my son’s face in her.”

Who’s the daddy?: “The bottom line is it’s our child. Please give us the respect and leave us alone. Let us raise our child, and let us be happy.”

On Friday, ET will be showing footage from Anna Nicole’s cesearean section! Wow.

Anna Nicole Smith's ex Larry Birkhead goes to court for custody of Dannie Lynn

In an attempt to seal his title as "Anna Nicole Smith‘s baby daddy," her ex-boyfriend Larry Birkhead is having his lawyer Deborah Opri ask a Los Angeles Superior Court judge for an immediate order for Anna to return to the United States so that a paternity test can be performed.  Larry is convinced that Anna’s newborn daughter Dannie Lynn is his.  (Anna has been in the Bahamas since her pregnancy.)  In addition to the paternity suit filed, his lawyer will also ask that Anna take drug tests.  You know what that means.  Larry wants custody of Dannie Lynn!

Meanwhile, Anna’s brand new husband/confidante/attorney Howard K. Stern went on the record on Larry King on September 26th stating that he is Anna’s baby’s genetic daddy.

In other Anna Nicole Smith drama news, according to Hollyscoop, Howard either sold or is trying to sell the exclusive photos of their wedding ceremony to the highest bidder.  We heard that People bought them for a million dollars but it hasn’t been confirmed.  We also hear (via Radar and Hollyscoop) that Anna and Howard weren’t actually married, that their wedding was actually a commitment ceremony.
