Dannielynn celebrates first birthday with a bash fit for a princess

Larry Birkhead went all out for his daughter, Dannielynn’s, first birthday party which took place a day after her birthday on September 8.  It included over 200 guests, an inflatable princess castle and two hot air balloons at the home of Tricia Barnstable Brown in Louisville, Kentucky. And while it was a princess theme, the character Barney made his appearance in a couple of places including the little girl’s high chair, where she ate a chocolate and vanilla castle shaped cake.

‘s Lara Spencer spent some time with Larry discussing various aspects of his daughter’s life including her mother, the late Anna Nicole Smith, who passed away when Dannielynn was five months old.  What would Larry say to Anna if he could on this special occasion?

I would say, ‘I hope you’re proud of the way she’s growing up and getting big.’

Dannielynn also lost her older brother, Daniel Smith, when she was just three days old and while he may no longer be here, you can still see glimpses of him in his sister. When asked about a resemblance between the two, Larry shared,

Yeah, sometimes. Especially when she gets out of the bath and her hairis parted to the side like a little boy, she looks a lot like Daniel.

Larry does everything that he can to try to ensure that his little girl will know her mother and brother. The 34-year-old father shared,

I show her pictures all the time and I say, ‘This is your mommy andthis is your brother Daniel.’ We talk about them all the time.

When all was said and done, Larry just wanted to provide his daughter with a fun day fit for a princess and when asked what he hoped to give her, he said,

Another happy day in life. I know she’s not going tounderstand everything that’s going on but just something that she cansay one day, ‘Wow, what a cool party, what a cool dad!’

Daniel Smith inquest began today…and is already stalled

Anna_nicole_smith320And so the Anna Nicole Smith saga continues, only this time regarding her late son. An inquest into the death of Anna Nicole’s 20-year-old son, Daniel Smith, who died in September, in a Bahamas hospital, stalled Tuesday before the court could even pick a jury.
Soon after the court convened, reporters were ordered to leave the courtroom when Wayne Munroe, a lawyer for the estate of Anna Nicole, asked the judge to consider a motion that “relates to the impaneling of a jury to act on this inquiry.”It is expected that the court could take at least another day to resolve the issue raised by Wayne Munroe and the inquest would not resume before Thursday. Jurors are excused until then.
The jury is expected to hear from dozens of witnesses, including Howard K. Stern, as they consider whether Daniel’s death should be ruled an accident, suicide or a homicide.In September, Dr. Cyril Wecht, a forensic pathologist hired by Anna Nicole herself, concluded that Daniel died from methadone and two antidepressants interacting in his system. But the case remains open, according to Bahamian authorities. The inquest is expected to last up to three to four weeks. If the jury finds criminal activity played a role, it would be up to the Bahamian attorney general’s office to pursue the case.

Does Anna Nicole Smith have a Native American son? Nope.

Marshall_sotoUpdate: The New Times reporter who wrote the story tells CBS Showbuzz that

[Johnny] spins quite a tale. He has documents to back it up and photos. I don’t know. I’m not anexpert in documents, (but) he had enough for me to believe that he waswho he said he was.

However, CBB reader Erin points us to Indianz.com and BlueCornComics.com, who say this paper regularly writes spoof news articles which they publish, angering readers who think they may be real. The piece was a joke meant to draw attention to the Indian reservation.

Originally posted 3:20 pm:A Native American man named Johnny Soto has come out of the woodwork saying that his son, Marshall Black Deer Soto, is Anna Nicole Smith‘s biological son.  And he says he has a birth certificate with Anna listed as the mother to prove it.

Florida judge says Larry Birkhead has to wait for California ruling

Dnatestkit_1 Florida family court Judge Lawrence Korda said that he can’t decide whether a DNA sample may be taken from Anna Nicole Smith‘s daughter Dannielynn to see if Larry Birkhead is her biological father because he doesn’t have jurisdiction.  Los Angeles County Superior Court Judge Robert Schneider will be making the decision on whether a DNA test may be performed.

The Florida judge ordered a DNA sample to be taken from Anna’s body prior to burial for future potential testing.  He also said, somewhat confusingly, that is it "conceivable" by Florida law for Dannielynn to have two fathers.  Huh?

Many people are asking what’s so difficult about performing this test that they won’t allow it to be take place.  It has nothing to do with actually performing the test.  It’s a fairly routine procedure- after all, they’re doing it on CSI all the time, right?  It’s also physically non-invasive- just swab the inside of the cheek (test kit pictured above). The overriding issue is Dannielynn’s current guardian’s desire to have the test performed. So the question is – why does Howard not want to have the test performed?  The most obvious answer is that Howard knows he isn’t Dannielynn’s biological father and in refusing to consent to the test, he secures his position as her guardian. 

TMZ’s sources tell them that Howard will cooperate if the price is right.  He wants the boat and house that Anna bought before her death (not where he is staying now). He would also get control of Dannielynn’s inheritance (which includes all of Anna’s assets).

In respect to the disposition of her mother’s body, Richard Milstein was a guardian ad litem, appointed to represent the interests of Dannielynn with respect to a single action.  He can’t make the decision in other actions. She will likely be assigned another in California, but it doesn’t appear that the person will be able to make the decision outside of a court.

Anna Nicole Smith's mother visits her granddaughter Dannnielynn

Anna Nicole Smith’s motherVirgie Arthur finallygot what she’s been wishing for, for weeks… a visitwith her granddaughter. Virgie was granted permissionto visit 5-month-old Dannielynn in the Bahamas on last night. She visited Dannielynn from 8-9 pm last night at Horizons, Howard K. Stern‘s current accommodations.  According to TMZ ‘s sources, when Virgie left, she looked and acted "distraught."  Larry Birkhead also visited Dannielynn for the first time this week.

Howard had previously deniedpermission for Virgie to visit the baby. Herlawyers talked with reporters on Tuesday:

She’s in mourning, having lost her daughter andgrandson both within the last five months. Ourobjective is really to assist our client in havingaccess to her granddaughter and foremost to ensure thebest interests and welfare of the child are secured.

Virgie is still fighting to have her daughter buriedin her native Texas, while Howard and Larry Birkhead are inagreement that Anna Nicole should be buried next toher son, Daniel Smith, in the Bahamas.
