Bobby Brown seeks reversal of custody ruling

The divorce and custody dispute between Bobby Brown and Whitney Houston may not be over after all.

Bobby, in a 5-page declaration filed April 26 in the Orange County California Superior Court, made some rather startling allegations in support of his request to dismiss an April ruling which awarded Whitney sole custody of their 14-year-old daughter Bobbi Kristina – namely, that he was homeless.  According to Bobby, he could not file an adequate response to Whitney’s divorce petition because at the time of their separation he "had nowhere to go and very little money to live on."

My marriage had fallen apart.  I was without a home, I had no money and I was experiencing legal problems associated with my child support obligations.  It was no wonder by the end of 2006 I had become distraught and depressed. Frankly, at the time I was not capable of and did not appreciate the importance of getting the paperwork … in on time.

Furthermore, Whitney allegedly told Bobby that they could take six months to work on their problems; Instead, the award-winning singer filed for divorce and fast-tracked the process in order to obtain a default judgment and full custody of Bobbi Kristina.  Seeking shared custody of their daughter as well as spousal support, Bobby says that Whitney’s legal maneuvering left him "shocked" and "surprised to say the least."

If Whitney wants a divorce, so be it.  But to deprive me of custody of our only child on a default basis …is unbelievable to me.  I believe that I have a wonderful relationship with my daughter Bobbi Kris — a relationship that I would like to see strengthen and grow.

I love Bobbi Kris dearly and want to spend as much time with her as possible.

A hearing on Bobby’s motion is scheduled for June 15.

I honestly want to feel bad for him, but I can’t. I feel more for Whitney. She’s trying to get her life back in order, and he (who didn’t bother to show up for the hearing, because he claims he was out of money, etc.) is just trying to milk her of the money she has left, IMO.

Ok, so he says he’s broke and pretty much homeless. He thinks a judge is going to take his daughter out of a home with her mother and let her live with a man who is struggling and can’t even pay child support for his other children? Please! Whitney made her choices, but I think that her taking Bobbi when she went to get herself help was a good thing. That little girl needs her mother right now, and while I know she needs her father too, I think it’s uncalled for that he thinks he should have custody as well as child support and spousal support, when Whitney didn’t ask for either when she was awarded custody.

I pray that Whitney and Bobbi Kristina get out of this ok, and I hope Bobby gets himself some help.

I personally think that Bobbi Kristina shoudl have the most say in who gets full custody. At fourteen, I fully think she is capible of making that decision.

I hope this is finally settled soon so everyone can get back to living.

I have no idea what lawyer was fool enough or publicity-hungry enough to take this case.
Like Ashley said, Bobby has admitted to being homeless at times and not realizing the importance of responding to the court action in a timely fashion. And he really thinks the judge is going to give the baby to the likes of him? Seems like he’s hitting Whit up for some more money.
