Court rejects Virgie Arthur's appeal; birth certificate officially changed
Although permission had been granted Wednesday for Larry Birkhead to bring his daughter Dannielynn, 7 1/2 months, home to the US, Anna Nicole Smith‘s mother Virgie Arthur filed a last-ditch appeal yesterday to attempt to prohibit the father and daughter from leaving. Today, the judge tossed out the appeal, saying that he, ‘is perplexed why this matter is before us’ and charging Virgie $3,000 in attorney fees for wasting the court’s time. After court, Larry remarked,
This whole thing wasn’t necessary. It was an expensive day for her. In a sense, I guess I got a divorce from Virgie for the child I didn’t know we had together…I hate that I have to come here for such nonsense. I have family that want to see the baby too, but they’re not here fighting me.
Howard K. Stern said,
I’m going to miss Dannielynn a lot, but I’m very happy [with] the result today, I’m very happy for Larry. Virgie has made outrageous statements about me, about being concerned with Dannielynn’s safety with me, and the appeal was asking to have Dannielynn stay in the Bahamas with me. You really have to question the motives.
I’m going to help Larry out in any way that I can, and if it takes years in the United States, I’ll do it. I am hopeful that everything will be taken out of the media so she can live as normal life as possible.
In other news, the amended birth certificate has been filed, and Larry was going to pick up Dannielynn’s passport today. He joked,
Of course, since I’m a photographer, I had to take the [passport] picture too. She’s very well lit!
